The law

What is Colombia’s 2 mg THC rule?

It is the line between controlled and non-controlled cannabis products. With 2 mg of THC or more per dose, the product is a controlled medicine (medicamento de control especial) under Resolution 315 of 2020, art. 5.

How the dose is counted

The dose is measured per tablet or capsule, or per gram or milliliter in oils, solutions and creams. THC is counted with its isomers and acid forms, such as THCA (Resolution 315 of 2020, art. 5).

With 2 mg or more per dose

  • The doctor prescribes it on the official prescription pad (recetario oficial), on paper (Resolution 1478 of 2006, arts. 81 and 84).
  • Each prescription covers at most 30 days of treatment (art. 80, as amended by Resolution 315 of 2020).
  • Only an establishment registered with the National Narcotics Fund or a departmental Narcotics Fund can dispense it (art. 12), and not if the prescription is more than 15 days old (art. 97).
  • As a rule, you pick it up at the pharmacy: the rule bans selling it «a través de Internet, correo u otro medio similar», that is, online, by mail or by similar means (art. 5, num. 4).

With less than 2 mg per dose

The product is not controlled, and an ordinary prescription is enough. It can be electronic (Decree 780 of 2016, arts. 2.5.3.10.15 and 2.5.3.10.16). According to Invima, home delivery is compatible with dispensing (Invima External Circular 1000-016-2026, num. 7).

Who decides

Your doctor decides the product and the dose. This rule only changes the type of prescription and how you receive the product.
